How to navigate the Commonwealth criminal law

This paper was presented to local criminal law practitioners at Legal Aid (Newcastle) in March 2015 and aims to provide a simple outline of the key issues and features of commonwealth criminal law.

It provides a brief outline of the constitutional derivation and legislative structure of the jurisdiction, identifies the features of a ‘Code’ jurisdiction particularly when it comes to identifying the elements of an offence, and outlines some of the key features of sentencing.

And please note – the section in the title is a work of fiction!
